COUNT 1
PETITION FOR ESTABLISHMENT OF NON-PATERNITY
OF THE MINOR CHILD, ISABEL
NOW COMES JACKSON, Respondent/Counter-Petitioner herein, and for her Petition for Establishment of Non-Paternity represents unto this Honorable Court as follows:
1. That on February 16 1994, a child, ISABEL, was born to JACKSON.
2. That pursuant to _________, SMITH is the presumed father of ISABEL.
3. That at all time since JACKSON'S pregnancy became known and subsequent to the birth of ISABEL, JACKSON has questioned SMITH'S paternity of ISABEL.
4. That subsequent to the birth of ISABEL, JACKSON, SMITH and the child submitted to paternity testing. The results of said paternity test exclude SMITH as the child's father. A copy of said results are attached hereto and made a part hereof as Exhibit "A".
5. That on May 13, 1997 SMITH filed an Amended Petition for Dissolution of Marriage and Other Relief in which he states that his is not the natural father of ISABEL.
WHEREFORE JACKSON prays this court enter an order:
A. Finding that SMITH is not the natural father of the minor child, ISABEL;
B. Providing that SMITH shall have none of the legal rights or duties of a parent with respect to the minor child, ISABEL; and
C. For such and other relief as this Court in equity deems just and fair.
COUNT II
PETITION FOR ESTABLISHMENT OF NON-PATERNITY
OF THE MINOR CHILD, TEAGEN
NOW COMES JACKSON, Respondent/Counter-Petitioner herein, pursuant to 750 ILCS 45/5 and for her Petition for Establishment of Non-Paternity represents unto this Honorable Court as follows:
1. That on March 19, 1997, a child, TEAGEN was born to ROSALBO.
2. That pursuant to 750 ILCS 45/5(a)(1), SMITH is the presumed father of TEAGEN.
3. That at all time since JACKSON'S pregnancy became known and subsequent to the birth of ISABEL, JACKSON has questioned SMITH'S paternity of ISABEL.
4. That on May 13, 1997 SMITH filed an Amended Petition for Dissolution of Marriage and Other Relief in which he states that his is not the natural father of TEAGEN.
WHEREFORE JACKSON prays this court enter an order:
A. Finding that SMITH is not the natural father of the minor child, TEAGEN;
B. Providing that SMITH shall have none of the legal rights or duties of a parent with respect to the minor child, TEAGEN; and
C. For such and other relief as this Court in equity deems just and fair.
